No Further Extension in Due Dates: CBDT Issues Order u/s 119, Rejecting All Representations for Extension in ITR Filing & Tax Audit Due Dates for AY 2020-21

The Apex Body CBDT has issued an Order u/s 119 of the Income Tax Act bearing F.No. 370153/39/2020-TPL, dated 11.1.2021, taking cognizance of the Hon'ble Gujarat High Court direction to look into the issue of extension of ITR filing and Tax Audit due dates for AY 2020-21 and has clarified that no further extension will be granted.

In the said Order, CBDT has mentioned that:

(i) The Government has been pro-active in providing relaxation to the taxpayers by extending due dates on 3 occasions;

(ii) Internationally, the extension provided by India is more genorous as compared to other countries;

(iii) The returns filing statistics of the current year indicates that returns filed in this financial year has already exceeded the returns filed in the previous year and

(iv) Any further extension would adversely affect the return filing discipline and shall also cause injustice to those who have taken pains to file the return before the due date. It would also postpone the collection of revenue thereby hampering the efforts of the Government to provide relief to the poor during these covid times.
